In New York State, drivers may be asked to take both a “breath test” and a “chemical test” during a DWI investigation. Before making the decision to arrest a driver for DWI, an officer will usually ask the driver to take a “breath test”, and to perform a series of field sobriety tests. In Buffalo, most DWI arrests follow this process:
- If the “breath test” shows that the driver has consumed alcohol, or if the officer determines that they have failed the field sobriety tests, they will be arrested.
- If the driver refuses to take the “breath test” or refuses to perform the field sobriety tests, the officer will typically arrest the driver for DWI based on the other facts that are typically observed in most DWI cases, such as an odor of an alcoholic beverage, slurred speech, and glassy or bloodshot eyes.
- Following the arrest, the driver will be taken to a police station and asked to take a “chemical test,” which officially records the driver’s blood alcohol content, or BAC. The “chemical test” usually consists of a test of the driver’s breath or blood, and will be used as evidence in trial.
